EasyLearnLive values the importance of safeguarding the integrity of personal information collected from its customers and clientele in compliance with the Australian Government Privacy Act of 1988. The following Privacy Policy covers how the company collects, secures, discloses or otherwise uses the personal data collected from its customers and clients; and includes the means and methods of access to, as well as correction of the information held by the company.

Our company collects personal information from our customers and clients during the initial purchasing process, prior to the downloading of content from our servers, as well as during the signing up process, which is part of our audio conferencing. Personal information may also be volunteered by our customers and clients as part of our customer service and survey processes.

We also collect data through the use of “Cookies” which are a form of internet technology designed to enrich the use of our website, by maintaining basic settings relating to the use of our website. What is personal data?

The EU General Data Protection Regulation (GDPR) defines personal data as “any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier.” This definition provides for a wide range of personal identifiers to constitute personal data, including name, identification number, location data or online identifier, reflecting changes in technology and the way organisations collect information about people.

How we store your data and keep it secure.

We store your data in a password protected, off-line contacts database on computers protected by Windows 10 Security. Backups of our contact database are stored in Acronis password protected AES 256 encrypted archives.

Your right to withdraw consent for your personal data to be used.

Retaining your information.

We retain your information, if relevant to sales related to you, for periods specified by Australian Taxation Office requirements or until such time as you request that we delete your personal data.

What is a personal data breach?

A data breach is any event in which the confidentiality, integrity and availability of information is compromised. Data doesn’t only need to be stolen to be breached; it might also have been lost, altered, corrupted or accidentally disclosed. Data breaches can happen to any kind of information, but we are most concerned with your personal data.

Reporting data breaches.

We will report Personal data breaches that “pose a risk to the rights and freedoms of natural living persons” to the EU Data Protection Authority (DPA) and to affected individuals within 72 hours of discovery.

Changes to this policy.

We may change this Privacy Policy from time to time and will not reduce your rights under this Privacy Policy without your explicit consent. We always indicate the date the last changes were published and we offer access to archived versions for your review. If changes are significant, we will provide a more prominent notice.

Terms of Service

The Terms of Service as enumerated herein, are intended to go above and beyond the minimal requirements of the applicable provisions of the law, to the maximum extent that is permitted under the law. Since the contents of these terms were entered into by electronic means, it is imperative that you print out a hardcopy of these Terms of Service.

Terminology

The terms, when used in this document, or in any other manner associated with the use of our website, our products or services, shall have the following meanings:

“Authentication Information” – Refers to any passwords, names or other security information submitted by the User, to allow the user access to the website.

“Company” – Any references to the Company, without any further definition, shall be assumed to be a reference to KonTech Australia Pty Ltd.

“Confidential Information” – Refers to any information submitted by a user to the website, which may be personally identifiable, or otherwise defined under the law as being confidential in nature.

“Exercise Files” – Any files, images, documents or videos that is used by an author during his or her course, regardless of whether such is via a recording, a live webinar or online consultation.

“Password Sharing” – Any sharing of passwords with another individual or organization, without the expressed written consent of the Company shall result in the termination of a User’s account.

“Phishing” – Shall refer to any scheme used by a third party to obtain Authentication Information from our Users. Users who believe that a third party has gained access to their Authentication Information shall be required to notify the Company immediately.

“Public Website” – Any portion of this website that is accessible to all non-member visitors to the site.

“Services” – Refers to the entire contents of this website, including its features, functionality, information and data, which includes but is not limited to software, images, text, videos, audio recordings, display, layout and design or any other arrangement thereof, including the Exercise Files, Standard Content or any other item relating to the website.

“User” – Refers to any individual and or organization that purchases or otherwise makes use of the products and services of EasyLearnLive and its website, www.easylearnlive.com.

“Virus” – any program, code or other device that is designed to impair, damage, prevent access to or in any other manner, affect the functionality of a computer software, hardware or telecommunications network which is capable of manipulating, deleting , altering, or erasing data within a program or otherwise create an unauthorized access to that data.

“Website” – Refers to the content contained within www.easylearnlive.com, including but not limited to the data, information, layout, design, functionality, images and other graphics, code, interfaces, or any other proprietary intellectual property contained therein.

“Confidential Information” means all portions of the Services.

Rights, Warranties, Restrictions, Obligations and Representations

• The end User shall agree to faithfully comply with any rule or other regulations published by the Company with regards to the use and or access to the website or the products and services offered by the Company, which form part of these Terms.

• The User also agrees that the Company may, or may not, at its own discretion, monitor the services offered within the website, and/or compliance with the Terms and Conditions of its use.

• Further, the end User also agrees as follows:

• The User will not transfer access to the non-public portions of the website to any third party;

• The User will not store, or in any manner distribute or transmit any viruses;

• The User will faithfully comply with any applicable law or regulation relating to the use of the services offered by the Company;

• The User will not copy, lease, rent, resell, sublicense, reproduce, distribute, transfer, modify or otherwise display or publically perform any services or products of the company to any third party;

• The User will not decompile, reverse engineer or otherwise reproduce, in part or in whole, any source code from any part of the website;

• The User will not attempt to delete, modify or otherwise alter any trademark, copyright or other intellectual property mark of the Company, which may be found on the website, or received by the User through any other means;

• The User shall be solely liable for maintaining their personal equipment, including but not limited to the acquisition, installation, operation and maintenance of any hardware or software necessarily required to access any part of the website or products and services offered by the Company;

• The User may not perform any act or omission, which may directly or inadvertently infringe upon the intellectual property rights of the Company, the website or any authors of the products and services offered by EasyLearnLive, nor will the User perform any act which may be defamatory, libellous, malicious or otherwise damaging to the Company, its products and services as well as its authors.

Website Availability

While the Company will do its best to ensure the continued availability of its products and services through the website, the end User recognizes the fact that the control of data and traffic through the Internet, is beyond the control of the Company itself and shall indemnify the Company for any delays that may be caused by the Internet or any necessary modification or maintenance of the website.

Intellectual Property Rights

• Any services, products or other data and/or technology which may be owned in part, or in whole by the Company, licensors or Authors are Intellectual Property and are thus protected under Australian and international intellectual property right laws, including but not limited to copyrights, trademarks, patents or other forms defined under the law. • At no time, shall any Intellectual Property of the Company or its Authors be transferred to the User or any third party, as the same is explicitly reserves. • Further, neither the User nor any other third party shall have the right to use any logos, names, products or services, which constitute as Intellectual Property of the Company or its Authors, without the express written consent of the Company or its respective owners.

Obligations of the Company

The Company will make any reasonable effort to ensure the availability and accessibility to its products and services at all times, except during times, which may be pre-scheduled exclusively for the maintenance and repair of the website. The Company cannot be held liable for any interruption of these products and services as a result of any Force Majeure, and the User must indemnify the Company for any failure on the end User’s part to comply with the Terms and conditions set forth.

Payment and Fees

• Taxes – It shall be the sole responsibility of the end User, to pay the necessary taxes and duties associated with the use and or purchase of the products and services from the Company, regardless of the national or international authority who applies the tariff.

Term and Termination

• Termination – The Company shall exclusively reserve the right to suspend access to, or otherwise terminate any account for any violation, real or perceived, of the Terms and Conditions set forth herewith. • Effect of Termination – In the event of a termination of account, the end User will no longer have any access to the products and services of the Company; but, that said termination will have no effect to any rights that existed prior to said termination.

Confidentiality

Both the end User as well as the Company, agrees to maintain the level of confidentiality as prescribed by law, with respect to any Confidential Information entrusted to either party for the use and/or access to the products and services of the Company.

Third Party Information or Links

At time, the Company may provide links to another website, at its sole discretion, which may or may not be operated by the Company. However, the end User shall indemnify the Company with respect to any liabilities that may arise through the following of these links to any third party website.

Disclaimers of Warranties / Statements

The use and/or access to the products and services offered by the Company are deemed to be at the end Users’ own risk. That is, these products and services are offered under an “as available” or “as is” manner, without any warranties, whether express or implied. At no point shall the Company make any statement with regards to the security, completeness, reliability or accuracy of the products and services offered by the Company, and the end User shall indemnify the Company of any liability associated with their personal belief that any warrantee or other form of guarantee exists, with regards to the products and services of the Company.

Liability Limitation

At no time should the indemnification of the company with respect to any liabilities defined under the law, caused by the negligence of the Company.

Individual Website User Residents of a European Union Member Country

The end User as well as any third party shall indemnify the Company, its officers and employees, authors and licensors for any loss, both consequentially and indirectly, as a result of the use of the company products or services, that may be unforeseeable, which includes but is not limited to the revenue, profit or savings losses, detrimental effects on business or the loss of any data.

Indemnity

The end User agrees to indemnify the Company, its officers, licensors and authors from any damages, expenses or losses resulting out of any breach of these Terms and Conditions, and likewise agrees to compensate the Company for any losses resulting out of the need to defend itself, its officers, licensors or authors from any claim resulting out of the sure of the products and services of the Company.

Survival

In the event that a competent body deems part of these terms invalid, the remaining provisions of these Terms and Conditions shall survives, including, but not limited to, intellectual property rights, confidentialities, payment of regular fees or indemnifications. That these terms shall be deemed to survive beyond the termination of the service.

Changes

The Company exclusively reserves the right to change, delete and or modify these Terms in any manner allowable under the law, without the express written consent of the end User, and in the event that any modifications are made to these Terms, the Company shall notify the end User of said changes. The changes shall take effect immediately upon their posting, and the end Users’ continue use of the products or services shall be deems an acceptance of these modifications.

Assignment

The end User agrees not to transfer any rights or obligations defined under these Terms to any other party, in part or in whole. The Company however, reserves the right to transfer or otherwise subcontract any or all of the obligations set herein, without the consent of the end User.

Injunctions

The end User agrees that he or she will not breach the obligation of confidentiality or intellectual property rights associated with the use of the products and services of the Company, and acknowledges the right of the Company to seek an injunction against the User from performing any action which may directly or indirectly violate these Terms.

Governing Law and Venue

The Terms set forth herewith, shall be governed exclusively under the applicable laws of South Australia, without any regards to any conflicts that may arise between the applicable laws of the end User’s locality. Further, the end User agrees accepts that any and all actions arising from the use of the products or services of the Company shall be handled exclusively by the courts of South Australia. However, providing that the end User resides in a member country of the European Union, he or she may initiate proceedings in their country of residence.

Any notices intended for the end User will be sent by the company to the User’s address of record, or to the email address as submitted by the User upon registration. The Company also reserves the right to broadcast notices to the end users through the website, in accordance with the applicable laws. These notices shall be deemed to have been delivered on the date sent electronically, three (3) days after the notice is posted on the Company website, or five (5) days after the same has been mailed through any postal or expediting service.

Force Majeure

The Company cannot be held liable for any interruption of services, or any delay or failure to perform, which is as a result of an act that is beyond the control of the Company. Acts which constitute a Force Majeure, include but are not limited to any acts of God, third party failures, labour disputes, terrorist attacks, changes in the laws governing the Company, or damages to the infrastructure necessary for the transmission of these services and/or products.

Privacy Policy and Website Use Policy

The end User agrees to faithfully comply with the Privacy Policy and Use Policy of the Website, upon the creation of their respective accounts, and shall be deemed to have agreed to any changes and/or modifications made by the Company, in the event that they continue to use the products or services of the company after having been given due notice of the changes in these policies by the Company. The end User also acknowledges, that the Company may use third-party services outside of the European Economic Area (EEA) to fulfil its obligations, and the end User shall indemnify the Company with regard to any conflicts arising from the policies of the said third parties.

Children’s Online Privacy Protection Act (COPPA)

Under the Laws of the United States, any end User under the age of thirteen (13), shall be required to obtain the permission of their parent or guardian prior to the use of the products and services offered by the Company. As the parent or guardian of the end User, you shall hereby express your consent to the continued use of the products and services of the Company, which may include, but is not limited to social media and other community related features of the Company. Continued use by the minor shall be deemed as an approval by the parent or guardian.

No Third Party Beneficiaries

At no time shall any party to these Terms be considered a third party beneficiary.

Severability

In the event that any provision of these Terms is deemed by a competent body to be contrary to the applicable laws, then the remaining Terms shall be in full effect. The Company reserves the right to change said provision to comply with the law when possible,

Waiver and Amendment

At no time should any failure on the part of the Company, to strictly enforce the terms and Conditions, be construed as any form of waiver on the part of the Company with regards to the affected provisions contained herein. Only waivers, which are expressly written shall be deemed valid

Complete Understanding

Under these Terms and in relation to the Privacy Policy and policy regarding the use of the website of the Company, the end User agrees that they understand and accept the obligations, and that these Terms supersede and agreement, representation or warranty, regardless of whether it is written or implied.

Copyright Notice

The information contained in all of our course and bonus resources is and will always remain the intellectual property of Kontech Australia Pty Ltd. Our Learning Guides and associated exercise files are protected in accordance with the Copyright Act provisions. Apart from Copyright Act permissions pertaining to copying for research, study or review, no part of our Learning Guides and course procedures may be reproduced in any form, or stored in a retrieval system or database, or distributed or transmitted in any form by any means, photocopying, electronic, recording, or otherwise without written permission from Kontech Australia Pty Ltd. User Contributions

As part of the end Users’ experience of the website, the Company encourages User contributions, but said contributions shall be guided as follows:

• In the event that the Company provides any form of interactive service on the website, including forums, and other means of User Interactive Services, the end User agrees to comply with the Content Standards set herein;

• The posting of these User contributions shall be non-confidential, and the same shall not be considered the intellectual property of the end User. By providing these contributions to the website, the end User agrees to give the Company the full and exclusive right to use this content, in any manner prescribed under the law, including but not limited to, reproduction, modification, distribution or disclosure to third parties. Content Standards

The following Content Standards shall be applicable to all User contributions, and or any other interactive service offered by the Company. Further, such contributions must comply with applicable laws and basic morals.

Without any limitations to the following, the end User’s contributions may not:

• Include any form of material that may be seen as defamatory, indecent, obscene, offensive, violent, hateful, discriminatory, abusive, harassing or in any other manner, objectionable in nature;

• Include any form of pornography or other sexually explicit material, regardless of its legality;

• Discriminate against another, or their rights, based on gender, ethnicity, religion, nationality, disability, age or sexual orientation;

• Infringe upon trademarks, patents, copyrights, trade secrets, or any other form of intellectual property rights of any other User or third party;

• Infringe upon constitutional, civil or other legal rights of another, including their rights to privacy, nor should the same contain any content that could results in criminal or civil liabilities;

• Promote or otherwise advocate any illegal activities, or unlawful acts;

• Cause any form of unjustifiable annoyance, or inconvenience to other Users, nor should the same be done with an intent of upsetting or embarrassing another User;

• Impersonate or otherwise misrepresent the User as being any other person or entity that they are not authorized to represent;

• Be used to conduct any form of sales or other forms of commercial activities; or

• Impress upon other Users that the User is endorsed or otherwise represents the Company.

Monitoring Enforcement and Termination

The Company and/or its representatives has the exclusive right to, but no obligation to monitor, review, edit or in any manner screen the individual contributions of another User, and that any contribution submitted by an end User does not reflect, in any manner, the views or beliefs of the Company, and that these contributions are in no way endorsed by the Company or its representatives.

The Company has the right to:

• Remove any User contribution;

• Refuse the inclusion of any contribution;

• Delete, modify or otherwise edit any contribution the Company deems to be inappropriate;

• Disclose personally identifiable information with any third party lodging a valid legal claim to any intellectual property, or any content which violates the criminal or civil rights of another; • Take the most appropriate actions defined under the law, for any contribution that violates any laws; or

• Terminate or suspend any end User who fails to comply with these Terms and Policies.

The Company also has the obligations to cooperate with law enforcement agencies, and will fully cooperate with such authorities upon demand, with regards to the personally identifiable information of any user contributing material that violates the laws and/or rights of another.

Since the Company does not review any contributions prior to their posting by the end User, we therefore cannot ensure that any material that violates the Content Standards or applicable provisions of the law, are removed promptly, but the same does not constitute as a waiver of liability on the part of the Company. The end User will indemnify the Company from any action by any third party, relating to any User contributions.

Infringement of Copyright

Copyright infringement is a serious crime and in the event that we receive a notice of such an infringement, we will respond and take the most appropriate action necessary to rectify the infringement.

The Company shall allow end User’s to link to the homepage of the website, so long as such links are done in a manner that complies with applicable laws, and that such is done in a manner that is both fair to the Company, and that does not in any manner damage the reputation of the Company. Further, no links should be posted in a manner that would misrepresent any form of endorsement or approval on the part of the Company; without express written consent.

Further, the website shall include social media features, which will allow the end User to:

• Link from their website, or certain approved third-party websites;

• Send and/or receive any email messages or other forms of communication, wherein the content requires a link to the website as a form of authority;

• Display portions of the public accessible portion of the website with links to the full content being referred to.

The end User may make use of these features in the manner provided to the Company, and in accordance with the Terms and Policies set herein. However, these features must comply with the following:

• Other than social networking sites, the link must not be placed on any website that the end User does not own personally, or has the lawful right to post on;

• The content may not be posted within a frame, and such links shall not be considered deep linking or done in an in-line manner;

• Any links must point to the homepage of the website;

• The content on the page of the website wherein the link is placed, must also comply with the Terms and Policies of the Company.

It is imperative, that the content of the website wherein any link to the website of the Company is placed, must also comply with the Content Standards as set forth in these Terms. In the event that the end User is found to have violated these linking terms, he or she agrees to rectify the issues immediately, else remove the link entirely.

The Company exclusively reserves the right to disable any and all social media features without notice.

No Promises

The end Users’ use of the website, and/or any products or services offered through or from the Company, is done so at the User’s own risk and is provided solely on an “as is” basis, without any form of warrantee or promises, implied or expressed. The Company makes absolutely no promises with regards to the security, quality completeness or accuracy of anything contained within the website, including such products or services. The end User will indemnify the Company from any form of warrantee or representation of any form.

Liability Limitation

At no point, shall the Company be held liable for any damages resulting from the use of the website, and/or any of the products or services offered therein. Sail limited liability shall extend to the officers and other representatives of the Company, as well as its Licensors, Authors and any third parties associated with the same. Further, said liability extends to any damages resulting from the visiting of any other third party site, which may have been linked to from the main website. The end User shall be solely responsible for any and all damages.

Changes

The Company exclusively reserves the right to change any of the Terms and/or Policies outlined herein at any time, without notice, and in accordance with the previously established time frames for notice. The continued use of the website and/or products and services after any changes constitutes as an agreement to such changes.

Equitable Relief

In the event that a breach in these Terms and Policies, or any breach in the intellectual property rights of the Company, that results in irreparable damage to the Company, the Company reserves the right to an injunction against the offender, and likewise, to any other form of just and equitable relief defined under applicable provisions of the law.

Governing Law and Venue

The Policies set forth are governed under the laws of South Australia, and by agreeing to these Terms, the End User agrees that any action against the Company, shall be brought before the courts of South Australia; except in the event that the User is a resident of a country that stands as a member of the European Economic Area (EEA), in which such litigations shall be filed in the country of residence.

Severability

In the event that nay provision of these Terms and Provisions are deemed to be contrary to law by any competent body, the same shall not affect the remaining provisions. Further, the Company reserves the right to change any offending provision to conform to the law if necessary.

Waiver and Amendment

At any point that the Company fails to enforce strict compliance with these Terms and Policies, the same shall not constitute as a waiver of the obligations set forth in these Terms and Policies. The Company reserves the right to monitor and enforce these Terms and Policies on a case to case basis.

Future Business Transactions

In the event that the Company is bought, sold or even merged with another company, the information contained within the website servers and databases, including any personally identifiable information, is transferred with this change of ownership. The end User agrees that in the event of such an acquisition of transfer of ownership, that all data shall also be transferred, provided that any party who purchases the assets of the Company, shall be subjected to the same Terms and Policies regarding the integrity and security of this personally identifiable data.

Complete Understanding

The end User agrees and understands that the entire contents of these Terms and Policies, along any documents referred to, shall constitute as part of the whole agreement between the Company and the end User, and supersedes any previous understandings.

Cancellation and Refund Policy

One of our most important priorities is to ensure that we offer the highest levels of satisfaction to our customers and clientele. It is therefore imperative that our products are capable of living up to your exacting needs and expectations; and in the event that they do not, it is our obligation to ensure that we are able to offer a return process that is both fair and transparent to all of our customers and clients regardless of product that you purchased. • Prior to being eligible for a cancellation on your purchase, you will be required to forward your Notice of Cancellation to support@easylearnlive.com. • Assuming that we receive your Notice of Cancellation at least 4 business days prior to the scheduled webinar (not including holidays), you will be eligible to receive a full refund on the webinar. • If you fail to submit your Notice of Cancellation prior to obligatory 4-day notice, you will not be eligible for a refund on the webinar; regardless of whether you ordered a recording of the particular webinar or not.

Technical faults:

• It shall be the sole responsibility of all attendees to ensure that their equipment meets the minimal requirements before the start of the particular webinar they will be attending. • If the technical fault is as a result of the attendee’s equipment, or a failure of the attendees Internet Service Provider (ISP), which adversely affects their ability to attend the live webinar, then the attendee will not be eligible for a Technical Refund. • In the event that there is a technical fault as a result of EasyLearnLive’s equipment and/or failure of the company’s ISP, which results in the cancellation of the webinar, then all attendees will be eligible for a full refund.

Online Recorded Courses:

Credits and refunds for online courses and recordings can only be made within 30 days of purchase by you as a customer and are net after all bank charges and fees are deducted. If the course or recording you purchased is not to your expectation, you can request a refund or credit from KonTech Australia P/L. At our discretion we reserve the right to offer a credit or a refund, depending on payment processing considerations. To request a credit or refund, email us with details of your request to support@easylearnlive.com. At our discretion, if we consider you are abusing our policy, we reserve the right to ban your account and to restrict all future use of our Services. If you violate these Terms and Conditions we may bar your account or disable your course access, negating your entitlement to receive any credit or refund.
